Terms and Conditions of Enrolling in and Use of NEWEUROPE™ Club
ACCEPTANCE OF TERMS THROUGH USE
By submitting your NEWEUROPE™ Club ("NECLUB") enrollment application to NEWEUROPE™ Corporation ("NEC"), the Owner and the Operator of the NEWEUROPE™ Club and the NEWEUROPE™ Club Web site, and by using this site www.neweuropeclub.net, you signify your agreement to the terms and conditions of your membership (“Terms of Use”) in and use of NEWEUROPE™ Club (NECLUB) site as given below including NEC’s Privacy Policy and you also agree to NEC’s overall corporate Web sites Terms Of Use policy and Privacy Statement.
If you do not agree to these Terms and Conditions of membership in and use of NECLUB and this site, do not enroll or use this site. We reserve the right, at our discretion, to update or revise Terms of Use. Please check the Terms and Conditions periodically for changes. Your continued use of NECLUB members site following the posting of the changes to these terms will mean you accept those changes.
If you are a minor, you are not permitted to enroll unless your enrollment is submitted as a gift by your parent or legal guardian. If you are a minor "you" and "your" shall mean and include the parent or guardian acting on your behalf.

MEMBERSHIP FEE – CANCELLATION POLICY
Membership in NECLUB costs $9.95 monthly and your monthly membership is charged to your credit card on reoccurring basis after initial 14 day free trial period.
Your credit card submitted to us via our secure form or via PayPal in the NEWEUROPE™ Club Enrollment Form will be charged automatically for $9.95 on a monthly reoccurring basis for your NEWEUROPE™ Club membership 14 days from the day of your initial enrollment in NECLUB. You have a free trial period of 14 days including the day of your enrollment during which you can cancel you NEWEUROPE™ Club membership and your credit card will not be charged. Your first monthly NEWEUROPE™ Club membership charge of $9.95 will be charged to your credit card on the 15th day from the day of your enrollment in NECLUB.
So, for example, if you joined NEWEUROPE™ Club on March 10, you will have a free trial period through March 23. On March 24 your card will be charged for the first monthly billing cycle for $9.95. The first billing cycle ends April 23 and the second billing cycle begins April 24. You are free to cancel your monthly membership in NEWEUROPE™ Club at any time. You can do this by filling out our NEWEUROPE™ Club Membership Cancellation Form or by calling NECLUB customer support at 407-275-1200, Monday – Friday, 6am – 9pm EST and verify your account information and NECLUB shall immediately cancel your account. When your monthly NEWEUROPE™ Club membership is terminated, we bill you for entire final month. A confirmation of final billing is sent to you by email.
NECLUB reserves the right to change NEWEUROPE™ Club monthly membership prices and/or benefits at any time and notify its members within minimum 30 days or a longer time period about such pending change.
MEMBERS BENEFITS
- Full and unlimited access to NEWEUROPE™ Club Web site and NEWEUROPE.NET™ (NEN) Portal with updated information on Europe available 24 hours a day. A custom personalized Home Page on NEN showing your important daily information, picked from a variety of topics and including any countries of Europe.
- Free monthly subscription to the NEWEUROPE™ Magazine for one year beginning with the first issue published after your enrollment is confirmed.
- NEWEUROPE™ Club members have access www.neweuropeclub.net offering the following: members only chat rooms, lists of European clubs and events in your area, product purchase discount updates and savings opportunities, InstaComm (e-mail messenger), assistance with job hunting, immigration and legal issues, travel to and from Europe, insurance, member only classifieds and personals ads, NEWEUROPE™ Phone Cards for long distance and international calling, assistance with finding other relatives and friends virtually anywhere in North America and in Europe, English language courses and much, much, more.
- 10%-30% off on purchase of all NEWEUROPE™ Club merchandise such as T-shirts, Sweatshirts, Jackets, Caps, CDs and other.
- Discounts on purchases of any products at any NEWEUROPE™ owned or licensed Retail locations around the world. This is a permanent discount available to NEWEUROPE™ Club members only. Club Card must be presented at time of purchase.
- Discounts to NEWEUROPE™ Club members on purchases of any NEWEUROPE™ products on various NEWEUROPE™ Web sites such as www.neweuropeshop.net, www.neweuropechoc.com, www.neweuropemusic.com and on NEWEUROPE.NET (NEN) Portal. No product discounts given for product purchases on these NEWEUROPE™ sites to non-members. Some discounts also give on product purchases owned and operated by other companies and linked to NEWEUROPE™ sites including NEN.
- Discounts and special offers at other retail locations operated by other European manufacturers or store chains, depending on the arrangement struck by NEWEUROPE™ with such companies. These stores or companies mainly carry various European goods. NEWEUROPE™ will provide you with complete lists of these additional companies, retail locations, and discounts as they become available. Card must be presented at time of purchase.
- NEWEUROPE™ Club members also receive 50% off on the cost of the entrance fee (if one is charged) for any NEWEUROPE™ special events such as special presentations, dinners, dance nights, singles nights, and other social gatherings organized by NEWEUROPE™ at various local regions or cities. Some larger events such as popular European band concerts organized by NEWEUROPE™ may not include this type of a discount but will include at least 10% discount. Please stay updated on these special events under the NEWEUROPE™ Events headings or tabs on the Web site.
- Two free classified ads per year on the NEWEUROPE.NET Portal. Blackout periods may apply.
- Travel discounts to Europe and Hotel Discounts in Europe. A list of airlines and European hotels offering discounts to NEWEUROPE™ Club members will be prepared and provided in the near future.
MEMBER CONDUCT
You agree that any information you provide to NEWEUROPE™ Club is truthful and accurate. You agree to not use NEWEUROPE™ Club to upload, post, email, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable or that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party.
You represent and warrant that you own or otherwise control all of the rights to any content you submit or post to or through the site; that the content is accurate; that use of the content you supply does not violate these terms of use and will not cause injury to any person or entity and that you will indemnify NEWEUROPE™ Club for all claims resulting from content you supply.
By submitting Content to any "Public Area"(e.g. public chat rooms, Discussion Groups, Classified Ads, Personal Ads, etc.) or responding to a request for Content from NECLUB you automatically grant, or warrant that the owner of such content has expressly granted, the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such content (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed for the full term of any Rights that may exist in such content.
You acknowledge that NECLUB does not pre-screen content submitted by members, but that NECLUB shall have the right (but not the obligation) in their sole discretion to refuse or move any content that is made available via NECLUB by any user that violates these terms of service or is otherwise objectionable.
You also acknowledge and agree that NECLUB may preserve content and may also disclose content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process(b) enforce these terms of service(c) respond to claims that any content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of NECLUB, its users and the public.
NECLUB-ISS grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of NECLUB, or where expressly permitted. You agree not to use or resell NECLUB or the services it provides for any commercial purpose, including, but not limited to, sending unsolicited commercial messages.

COPYRIGHT
All materials on www.neweuropeclub.com as well as all other ISS Web sites are protected by copyrights which are owned and controlled by NEWEUROPE™ Corporation, it's affiliates, or other parties that have licensed to NECLUB the right to use their material ("Copyrights"). Except as explicitly set forth, material from any NECLUB site may not be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way. Modification of the materials or use of the materials for any other purpose is a violation of the copyrights and other proprietary rights including but not limited to the trademarks. The use of any such material on any other web site or computer network environment is prohibited by these Terms and Conditions of Use.
Anything a user sends to NECLUB, as between the user and NECLUB, becomes the sole property of NECLUB and is transmitted at the sole risk of the user. NECLUB will assume no liability for interception of such transmissions. NECLUB will respond to customer inquiries and may also provide promotional information via email.
UNSOLICITED SUBMISSIONS
NECLUB welcomes comments regarding its products and services as well as your opinions. However, NECLUB's policy is not to accept or consider creative ideas, suggestions or materials other than those it has specifically requested. We hope you will understand that the intent of this policy is to avoid misunderstandings when projects developed by NECLUB's very productive staff are similar to someone else's creative work. Accordingly, we must ask that you not send us any such ideas. If, despite our request that you not do so, you send us creative suggestions, ideas, notes, drawings, concepts or other information (collectively, the "Information"), the Information shall be deemed, and shall remain, the property of NECLUB. None of the Information shall be subject to any obligation of confidentiality on the part of NECLUB and NECLUB shall not be liable or owe any compensation for any use or disclosure of the Information, other than such liability as arises out of the copyright or patent laws of the United States .

To the fullest extent permissible pursuant to applicable law, NECLUB disclaims all warranties, expressed or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and title to any of the materials provided on this site. NECLUB does not warrant that the functions contained in the materials will be error free, that defects will be corrected, or that the site or server that makes it available are free of viruses or other harmful components. NECLUB does not warrant or make any representations regarding the use or the results of the use of the materials in this site in terms of their correctness, accuracy, reliability, or otherwise. You (and not NECLUB) assume the entire cost of all necessary servicing, repair, or correction. Applicable law may not allow the exclusion of implied warranties, so the above exclusion may not apply to you.
LIMITATION OF LIABILITY
Under no circumstances, including, but not limited to, negligence, shall NECLUB be liable for any special or consequential damages that result from the use, or the inability to use, any site, services, or materials in any site, even if NECLUB or a NECLUB Authorized Representative has been advised of the possibility of such damages. In no event shall the aggregate liability of NECLUB exceed the total charges set forth on the itinerary giving rise to such liability. Applicable law may not allow the limitation or exclusion of liability of incidental or consequential damages, so the above limitation or exclusion may not apply to you. In no event shall NECLUB’s total liability to for all damages, losses, and causes of action (whether in contract tort including, but not limited to, negligence or otherwise) exceed the amount paid by you, if any, for accessing this site.
PRODUCT INFORMATION DISCLAIMER
It is our intent to provide the most accurate and up-to-date information available throughout the site and in our communications with you. Occasionally, information on NECLUB may contain typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and/or availability. NECLUB reserves the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice, including after your order has been submitted. In addition, we reserve the right to cancel orders due to lack of availability, including after your order has been submitted. We apologize for any inconvenience this may cause you.
INTERNATIONAL USE
Accessing NECLUB materials and services from locations outside the United States where their contents are illegal is prohibited. Those who choose to access any NECLUB site from outside the U.S. do so on their own initiative and are responsible for compliance with their local laws.
TERMINATION
NECLUB reserves the right, in its sole discretion, and without liability, to terminate your member status to all or part of any NECLUB Club site or services, with or without notice, and to deny the purchase of any products or services, if you fail to comply with any term or provision of this agreement. Upon termination you must destroy all materials obtained from NECLUB and all copies thereof, whether made under the terms of this agreement or otherwise.
INDEMNIFICATION
Upon a request by NECLUB, you agree to defend, indemnify, and hold harmless NECLUB and its subsidiaries and other affiliated companies, and their employees, contractors, officers, and directors from all liabilities, claims, and expenses, including attorney’s fees, that arise from your use or misuse of this site. NECLUB reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with NECLUB in asserting any available defenses.
OTHER
These terms shall be governed by and construed in accordance with the laws of the State of Florida, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or related to these terms shall be filed only in the state or federal courts located in Orlando, Florida and you hereby consent and submit to the personal jurisdiction of such courts for the purpose of litigating any such action. If any provision of these terms shall be unlawful, void, or for any reason unenforceable, that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between us relating to the subject matter herein.
